Rock and Hard Place

There is no safe haven for online casinos.  That is the main problem for the industry in the United States.  There are absolutely no regulations in place to defend and protect the business.  However, at the same time there are law really in place to enforce against online casinos.  Some would argue the Unlawful Internet Gambling Enforcement Act, but the Unlawful Internet Gambling Enforcement Act does not really out law online casinos the way the title of the law implies.

The Unlawful Internet Gambling Enforcement Act is something of a ban on online casinos, but it does not outlaw the industry.  It simply forbids specific financial institutions from processing transactions for online casinos.  Since the law was passed in 2006, gamblers have founds several legal ways of getting around the Unlawful Internet Gambling Enforcement Act so that they may enjoy playing at their online casinos.  In addition to all of this the Unlawful Internet Gambling Enforcement Act is not supposed to go into effect until December of this year.

Yet, clearly, there is no love loss between the United States government and online casinos, because regardless of there being no clear laws against online casinos, online gambling companies are being attacked by law enforcement.  The problem with working in an industry with nor regulations is that there are all sorts of allegations that the government can through at you that are very difficult to defend against.  While not many cases are founded on the Unlawful Internet Gambling Enforcement Act several are based on the inapplicable Wire Act and many processors are charged with money laundering.
